This Privacy Policy (the “Policy”) describes our privacy practices regarding the collection, use and transfer of personal information collected through the internet, including our website www.hammersearch.com (the “Website”) and other personal information gathered by Hammer Search Partners in relation to the provision of recruiting services (“Recruiting Services”). By using the Website, you signify your agreement to the terms and conditions of this Policy. If you do not agree to this Policy, please do not use the Website. Hammer Search Partners reviews its privacy practices from time to time, and that those practices are subject to change. We ask that you bookmark and periodically review this page to ensure continuing familiarity with the most current version of our Privacy Policy. Any changes to our Policy will become effective upon posting of the revised Policy on the Website. Use of the Website following such changes constitutes your acceptance of the revised Policy then in effect. PERSONAL INFORMATION WE COLLECT.
Hammer Search Partners collects personal information (such as name, e-mail address and physical address) and other information that visitors to the Website choose to provide to us. For example, information is provided when a visitor registers as a candidate for our Recruiting Services, uploads a resume or responds to employment opportunities posted by us on the internet. We also collect personal information when you contact us via e-mail. Such personal information may include your User ID, password, the pages visited, and the duration of the visit to the Website, name, address, telephone number, e-mail address, resume information (e.g., employment history, education, job qualifications, professional credentials, memberships in professional organizations, skills, language skills, hobbies), citizenship, information from former employers and other references, and any other information relating to you, to the extent we have acquired or you have provided us with such information. We encourage you not to provide sensitive information to us. To the extent that you elect to include sensitive information on your resume, we will retain that information. We may collect personal information related to race and gender for diversity purposes.
HOW WE USE AND DISCLOSE THE INFORMATION WE COLLECT.

(1) Personal Information Concerning Candidates.
• Identifying positions of interest. We use personal information that we have collected concerning candidates to identify professional opportunities that we think may be of interest. We may contact potential candidates from time to time regarding such opportunities.
• Providing information to prospective employers and references. We provide personal information regarding candidates to prospective employers only if the candidate has authorized us to do so, to fulfill search requests from our clients.
• Soliciting information regarding candidates. We may contact individuals from time to time to solicit information regarding potential candidates in connection with a search that we are conducting.
• Refining our Recruiting Services. We may use personal information that we collect concerning candidates for purposes of developing and improving our Recruiting Services, and for purposes of collecting and disclosing diversity statistics and other statistical information regarding our candidates and placement activities.
(2) Personal Information Concerning Clients.
• We collect personal information pertaining to our clients, including business contact information, and retain and use such information in providing our Recruiting Services. We may contact you from time to time regarding your needs and the services that we provide.
(3) Other Uses of Personal Information.
• Updating your data. We may contact you from time to time to ensure that the personal information we have collected about you is accurate and current.
• Responding to your inquiries. If you contact us by e-mail or through the Website, we may keep a record of your contact information and correspondence, and we may use any contact information you provide in your message to respond to your inquiry.
• Promotional. Hammer Search Partners may from time to time send informational or promotional e-mails concerning its Recruiting Services.
• To respond to complaints and other inquiries. We may use personal information to establish procedures to receive and respond to complaints and inquiries.
• For research surveys. We may use personal information such as e-mail or postal addresses to conduct surveys relating to our Recruiting Services.
DISCLOSURE TO AFFILIATES, CLIENTS, SERVICE PROVIDERS AND OTHERS.
(1) Hammer Search Partners and its affiliates, subsidiaries and strategic alliance partners jointly use the personal information submitted to us for the purposes stated above. If you would prefer not to have your personal information used by Hammer Search Partners, please simply let us know by contacting us as indicated below and we will remove or suppress your personal information in our database.
(2) Disclosure to prospective employers or reference sources. We provide personal information regarding candidates to prospective employers or reference sources only if the candidate has authorized us to do so.
(3) Disclosure to service providers. Hammer Search Partners works with third parties who provide services that may include, but are not necessarily limited to, assessment services, including assessment validation services; website hosting, software services, data backup and other IT services; data analysis; resume verification; background checking; payroll services; public relations services; attorneys, accountants, and other administrative and data back-up and security services. As part of providing those services, such third parties will be provided with access to personal information. From time to time, we may contract with an e-mail marketing firm to perform a promotional mailing. We will provide the firm with a list of e-mail addresses for persons who have requested not to be contacted by Hammer Search Partners via e-mail, for purposes of suppressing e-mails to these individuals.
(4) Others. Hammer Search Partners may also disclose personal information in order to: (i) comply with applicable laws; (ii) respond to inquiries or requests from public or government authorities; (iii) comply with valid legal process; (iv) protect the rights, privacy, safety or property of Hammer Search Partners, Website visitors or the public; (v) permit us to pursue available remedies or limit the damages that we may sustain; (vi) enforce our Terms of Use; or (vii) respond to an emergency. We cannot and do not assume any responsibility for the actions or omissions of third parties, such as clients, including the manner in which they use personal information received either from Hammer Search Partners or from other independent sources.
(5) Business Transfers. Hammer Search Partners reserves the right to disclose or transfer, any and all personal information that we collect from visitors, or that we otherwise collect in connection with the Recruiting Services, to a third party in connection with a strategic alliance with such third party, or in the event of a sale of our company or one of our affiliates, a merger or consolidation involving Hammer Search Partners or one of its affiliates, or a sale or transfer of assets or of any portion of our business or the business of one or more of our affiliates.
TRACKING DATA.
Hammer Search Partners may monitor visitor traffic patterns throughout the Website by logging Tracking Data, which is collected automatically from each Website visitor. Tracking Data may include personal information such as the IP address of the visitor’s computer, its browser type and operating system, the referring site, which pages of the Website were visited, the order in which they were visited and which hyperlinks were “clicked.” Hammer Search Partners uses Tracking Data in aggregate form to perform statistical analyses of the collective characteristics and behavior of our visitors, and by measuring demographics and interests regarding specific areas of the Website.

The provision of personal information by you is entirely voluntary and you have the right not to provide personal information. You may request to be removed from Hammer Search Partners database simply by putting “Remove User” in the subject line of an e-mail to privacy@hammersearch.com, and include your full name, User ID and telephone number in the body of the e-mail message. We will use reasonable efforts to comply with your request. We may need to contact you in order to be sure that we are deleting the appropriate information. Please keep in mind that residual information will remain within Hammer Search Partners databases, access logs and other records, which may or may not contain personal information about you. The residual information will not be used for commercial purposes. However, Hammer Search Partners reserves the right, from time to time, to re-contact former users of our Recruiting Services.
SECURITY.
Hammer Search Partners has security measures in place to protect against the loss, misuse and alteration of personal information about Website visitors which is under our control. Unfortunately, however, no security system, or system of transmitting personal information over the Internet, can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee that personal information transmitted between your computer and Hammer Search Partners’ sites will be entirely secure. Please do not send highly sensitive information using the Internet.
